These services include but are not limited to providing targeted marketing strategies, generating qualified leads, and facilitating the connection between insurance companies and potential clients.
3. Client Responsibilities
Clients must provide accurate and up-to-date information regarding their insurance products, target audience, and any other relevant details necessary for lead generation. Clients are responsible for ensuring compliance with all applicable laws and regulations governing insurance services in South Africa.
4. Lead Quality
While our Agency endeavors to provide high-quality leads, we cannot guarantee the conversion of leads into actual customers. Lead quality may vary, and clients acknowledge that the ultimate success of converting leads lies within their own sales and marketing efforts.
5. Payment
Clients agree to pay the fees outlined in the service agreement between the Agency and the client. Payment terms, including billing cycles and payment methods, will be specified in the agreement. Failure to make timely payments may result in the suspension or termination of services.
6. Intellectual Property
All intellectual property rights related to the services provided by the Agency, including but not limited to trademarks, logos, and marketing materials, remain the property of the Agency. Clients are granted a limited, non-exclusive license to use such materials solely for the purpose of promoting their insurance products.
7. Confidentiality
Both parties agree to maintain the confidentiality of any proprietary or sensitive information exchanged during the course of their business relationship. This includes but is not limited to client data, marketing strategies, and lead generation techniques.
8. Termination
Either party may terminate the service agreement by providing written notice to the other party. Upon termination, clients remain responsible for any outstanding fees incurred up to the termination date.
9. Limitation of Liability
In no event shall the Agency be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of our services. Our liability is limited to the total fees paid by the client for the services rendered.
10. Indemnification
Clients agree to indemnify and hold harmless the Agency, its employees, and affiliates from any claims, damages, or losses arising from the client’s use of our services or any breach of these Terms.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of South Africa. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of South Africa.
12. Amendments
The Agency reserves the right to modify or amend these Terms at any time without prior notice. Clients will be notified of any changes, and continued use of our services constitutes acceptance of the revised Terms.
13. Entire Agreement
These Terms constitute the entire agreement between the parties and supersede any prior agreements or understandings, whether written or oral, relating to the subject matter herein.
